1. Acceptance of Terms

By creating an account or using Daytraq, you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. Description of Service

Daytraq provides a CRM platform for real estate professionals, including voice note capture, AI transcription, contact management, task tracking, pipeline management, and AI-powered insights. The Service is available via iOS app and web dashboard.

3. Account Responsibilities

• You are responsible for maintaining the security of your account credentials.
• You must provide accurate information when creating your account.
• You may not share your account with others or create accounts on behalf of others without authorization.
• You are responsible for all activity that occurs under your account.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any regulations
• Upload content that is harmful, harassing, or violates any third party's rights
• Attempt to gain unauthorized access to any part of the Service
• Reverse-engineer, decompile, or disassemble the Service
• Use automated tools to scrape, crawl, or harvest data from the Service
• Interfere with the operation of the Service or its infrastructure

5. Your Data & Content

You retain ownership of all contact records, notes, voice recordings, and other content you create in Daytraq. By using the Service, you grant us a limited license to store and process your content solely to provide the Service to you.

You represent that you have the right to collect and store the contact information you upload, and that doing so complies with applicable privacy laws (including GDPR and CCPA where applicable).

6. Subscription & Billing

Certain features require a paid subscription. Subscription fees are billed in advance on a monthly or annual basis. All fees are non-refundable unless required by law. We reserve the right to change pricing with 30 days' notice. Continuing to use the Service after a price change constitutes acceptance of the new pricing.

7. Termination

You may cancel your account at any time from the Settings screen. We may suspend or terminate your account if you violate these Terms. Upon termination, your right to use the Service ceases immediately. We will delete your data in accordance with our Privacy Policy.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DAYTRAQ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS OR DATA, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Governing Law

These Terms are governed by the laws of the State of Nevada, United States, without regard to its conflict of law principles. Any disputes shall be resolved in the courts of Clark County, Nevada.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or in-app notice. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
